Segundo a Justiça espanhola, o Google deve conceder o direito ser esquecido na internet (Lionel Bonaventure/AFP)
O Tribunal de Justiça da União Europeia (TJUE) determinou nesta terça-feira que o Google deixe de exibir em seus resultados de busca links relacionados a usuários se estes assim demandarem. As informações só não podem ser excluídas das buscas se, segundo o Tribunal, os dados forem de interesse público. A decisão se apoia na lei de proteção de dados da UE, que prevê que os cidadãos têm o “direito de serem esquecidos” em determinadas situações.

A decisão é o último capítulo de uma ação iniciada pelo espanhol Mario Costeja Gonzalez em 2009. Ele afirma que naquela data o buscador ainda exibia notícias relativas ao processo que ele sofrera em 1998 em que, por débitos, perderia sua casa. Gonzalez, então, acionou a Agência Espanhola de Proteção de Dados contra o jornal espanhol La Vanguardia, que publicara as informações, e o Google, que exibia os dados em sua página de buscas. Para Gonzalez, o conteúdo deveria ser removido por não ter mais nenhuma relação com seu nome.
Na época, o órgão espanhol não aceitou a denúncia contra a publicação por considerar que o jornal “publicou legalmente a informação”, mas considerou que o Google deveria adotar as “medidas necessárias para retirar os dados” de sua plataforma. Na ocasião, o gigante de buscas considerou o ato censura.
A Agência Espanhola, por sua vez, apresentou recurso na Justiça, que considerou o Google responsável pelo tratamento dos dados pessoais armazenados em seu sistema. “O Google deve conceder aos usuários o direito ser esquecido na internet, mas em determinadas condições”, decidiu o Tribunal. “Os links para sites que contêm essa informação devem ser suprimidos da lista de resultados, a menos que existam razões específicas – como o papel desempenhado por esta pessoa na vida pública – que justifiquem que prevaleça o interesse do público a ter acesso a essa informação ao efetuar a busca”, diz o despacho do Tribunal.
