Um tribunal federal de apelações dos Estados Unidos nesta sexta-feira concedeu a Oracle uma pequena vitoria em seu caso contra o Google.
Em um comunicado sobre o assunto, Oracle General Counsel Dorian Daley disse que eles estavam extremamente satisfeitos que o tribunal negou a tentativa do Google para limitar drasticamente a proteção de direitos autorais. É uma vitória para Oracle e para o setor de software que se baseia na proteção de direitos autorais para estimular a inovação e garantir que os desenvolvedores serão recompensados por suas descobertas.
O caso decorre de uma ação movida há quatro anos pela Oracle em que reivindicam o uso do Google nas interfaces de programação de aplicativos (APIs) Java no sistema operacional móvel Android, que constitui uma violação de direitos autorais.
No julgamento original, o júri concluiu que o Google, de fato, usa APIs pertencentes à Oracle no Android, mas eles estavam num impasse sobre se era considerado o uso dos tais justo. Essa utilização permite a cópia de material em algumas circunstâncias.
O caso agora vai voltar para o Tribunal Distrital dos EUA em San Francisco, onde ainda outro júri terá a tarefa de decidir se o uso das APIs cai sob a categoria de uso justo.
Daley disse que a Oracle está confiante de que o tribunal distrital irá adequadamente aplicar a doutrina de uso justo.
